Terms and conditions of sale

1. Purpose and scope

These general terms and conditions of sale ("Terms") apply to all orders placed on prodiagauto.com, published by ProDiagAuto (see the Legal notice). They are intended for all car enthusiasts, whether buying for personal use or as part of a professional activity. Placing an order implies unreserved acceptance of these Terms.

2. Products

ProDiagAuto sells car cleaning consumables and accessories, individually or as kits. The essential characteristics of each product are shown on its product page. It is the customer's responsibility to check that the product suits the intended use before ordering. Photographs are not contractually binding.

3. Prices

Prices are shown in euros. VAT not applicable, article 293 B of the French General Tax Code (CGI). Shipping costs are shown before the order is confirmed. For deliveries outside the European Union, customs duties and local taxes may be payable by the recipient. Products are sold at the price in force when the order is confirmed.

4. Orders

The order is final once payment is confirmed. A confirmation email is sent to the customer. ProDiagAuto reserves the right to cancel an order in the event of a payment dispute, an obvious pricing error or product unavailability; the customer is then refunded in full.

5. Payment

Payment is made in full at the time of ordering, using the methods offered at checkout. Transactions are secured by our payment provider; ProDiagAuto never has access to bank details.

6. Delivery

Products are shipped with a tracking number, sent by email as soon as they are dispatched. Delivery times shown are estimates. On receipt, the customer checks the parcel in the presence of the carrier and notes any damage. See the Shipping and returns page.

7. Right of withdrawal (consumers)

In accordance with articles L.221-18 et seq. of the French Consumer Code, consumers have 14 days from receipt to withdraw, without giving a reason, by writing to us via the Contact page. The product must be returned complete, unused and in its original packaging within 14 days of withdrawal. Return shipping costs are the customer's responsibility. The refund, including initial shipping costs (based on the standard rate), is made within 14 days of withdrawal; it may be withheld until the returned product is received.

8. Business purchases

The right of withdrawal does not apply to purchases made as part of a professional activity. Any damaged or non-conforming product must then be reported in writing within 3 days of receipt. ProDiagAuto's liability for a business purchase is limited to the amount of the order concerned.

9. Legal guarantees

Consumers benefit from the legal guarantee of conformity (articles L.217-3 et seq. of the French Consumer Code, 2 years from delivery) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). Business purchases benefit from the guarantee against hidden defects. No additional commercial guarantee is granted.

10. Liability

Products must be used in accordance with their instructions and good practice. ProDiagAuto cannot be held liable for damage resulting from misuse or from a product unsuitable for the surface being treated.

11. Personal data

Data processing is described in our Privacy policy.

12. Mediation and disputes

In the event of a dispute, the customer first contacts ProDiagAuto via the Contact page to find an amicable solution. In accordance with articles L.612-1 et seq. of the French Consumer Code, consumers may then use a consumer mediator free of charge. These Terms are governed by French law. Failing an amicable agreement, the French courts have jurisdiction.
